Motion
WHEREAS the Sudbury & District Board of Health has a duty to promote and protect the health of residents in the Sudbury & District Health Unit catchment area; and
WHEREAS in discharging this duty, the Board of Health upholds a variety of legislative acts, including those respecting freedom of information and protection of privacy and respecting food premises; and
WHEREAS the Board of Health has considered advice from the Information Privacy Commissioner (Ontario) and legal counsel; and
WHEREAS the Sudbury & District Board of Health recognizes the need for the community to be informed of enforcement activities with respect to protecting health; and
WHEREAS website-based disclosure would enable the public to readily access information regarding enforcement activities;
NOW THEREFORE BE IT RESOLVED that the following will be the Sudbury & District Board of Health policy on the release of enforcement and food premises inspection information:
1. Charges:
Statistical information only (no identifying information) will be released to the Sudbury & District Board of Health at its regular meetings.
Charges issued under the Ontario Food Premises Regulation will be released to the public via the Sudbury & District Health Unit website for a period of 12 months from the date of issue.
2. Convictions:
Information related to convictions will be released to the public on request.
Information related to food premises convictions will be released to the public via the Sudbury & District Health Unit website for a period of 12 months from the date of conviction confirmation.
3. Closures related to Food Premises
Closures of food premises will be released to the public via the Sudbury & District Health Unit website for a period of 12 months from the date of issuance.
4. Routine Inspection Reports related to Food Premises:
Findings of Routine Inspection Reports will be provided to the public via the Sudbury & District Health Unit website for a period of 12 months from the date of inspection.
5. Requests for information not posted on website:
Requests for information not posted on the website will be considered on an individual basis. Requests for information that is complex or extensive in nature must be made in writing. Should the request be granted, the requestor may be required to cover the costs associated with fulfilling the request. The requestor will be notified of such cost prior to the request being fulfilled.
AND FURTHER THAT a press release be issued informing the public of this policy; and
FURTHER THAT motion 48-07 is hereby rescinded.
